Please read these terms carefully before using the PakiCheckout platform.
1. Acceptance of Terms
By accessing or using PakiCheckout ("the Platform"), operated by PakiCheckout ("we", "us", "our"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Platform. These terms apply to all users, including merchants, customers, administrators, and visitors.
2. Description of Service
PakiCheckout is a multi-tenant commerce platform that enables merchants to sell products and services to customers in the United Kingdom. Our services include hosted checkout, payment processing facilitation, order management, payout management, and a WordPress/WooCommerce integration plugin.
3. Merchant Accounts
To use our merchant services, you must create an account and complete our onboarding process. You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate, complete, and current information during registration. We reserve the right to suspend or terminate accounts that violate these terms or provide false information.
4. Merchant Obligations
As a merchant, you agree to: (a) comply with all applicable laws and regulations in your jurisdiction and the jurisdictions where your customers are located; (b) provide accurate product descriptions and pricing; (c) fulfill orders promptly and professionally; (d) handle customer disputes and refunds in accordance with your stated policies; (e) not use the Platform for any illegal or prohibited activities.
5. Payments and Fees
We charge transaction fees as outlined on our pricing page. Fees are deducted from each transaction before settlement. Payout schedules depend on your plan tier and account standing. We reserve the right to hold funds for review when suspicious activity is detected. All fees are non-refundable unless otherwise stated.
6. Payouts
Payouts are processed according to your plan's schedule. We may delay or withhold payouts if we suspect fraudulent activity, receive chargebacks, or need to conduct compliance reviews. You must maintain valid banking information for payout processing.
7. Prohibited Activities
You may not use the Platform to: sell prohibited goods or services; engage in money laundering or terrorist financing; process transactions for illegal purposes; misrepresent your identity or business; interfere with Platform operations; attempt to gain unauthorized access to our systems; or resell or redistribute our services without authorization.
8. Intellectual Property
All content, trademarks, and intellectual property on the Platform are owned by PakiCheckout or its licensors. You may not copy, modify, distribute, or create derivative works from our Platform without prior written consent. The WordPress plugin is provided under license for use with your PakiCheckout account only.
9. Limitation of Liability
To the maximum extent permitted by law, PakiCheckout shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the fees paid by you to us in the twelve months preceding the claim. We are not liable for losses caused by third-party payment processors, banking institutions, or merchant actions.
10. Termination
Either party may terminate the relationship at any time. Upon termination, any outstanding balances will be settled according to our standard payout schedule, less any applicable holds or reserves. We may terminate or suspend your account immediately if you breach these terms.
11. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the updated terms.
